Asencio Case: Between 1 and 5 Years of Imprisonment Are Discussed for the Distribution of the Sexual Video

However, a dark cloud is always present on his horizon, and today new news has emerged.

The Reported Facts

It concerns the dissemination of a sexual video featuring several Real Madrid youth players on June 15, 2023, in Mogán (Canary Islands). Among them is the alleged presence of Asencio.

This group of footballers engaged in consensual sexual relations with two girls, one of whom was a minor, 16 years old. One of the footballers recorded the images, which were then distributed on social media without the girls' knowledge or consent.

Today, the Las Palmas Court has rejected the appeal filed by Raúl Asencio's defense. It did so in reply to the decision of the Investigating Court number 3 of San Bartolomé de Tirajana to continue the investigation of the player. The reason: an alleged dissemination of a sexual video of a 16-year-old minor.

The accusation maintains that during the recorded relations, there was a third person present, and the images were later disseminated. Allegedly, the videos were distributed by Asencio to a contact after reaching his mobile phone.

Asencio's Defense Requested the Case Be Dismissed

Asencio's defense requested the case be dismissed, but the First Section of the Las Palmas Court has confirmed today the decision to continue the investigation.

The case affects Raúl Asencio and three other Real Madrid youth players at that time. The ruling states that there are sufficient "rational indications" of criminality. It also considers the possibility that Asencio could have committed a crime of discovery and disclosure of secrets, incurring in another of child pornography.

One of the investigated stated that Asencio showed him the video, along with mobile records indicating that he received it on WhatsApp.

The ruling also indicates that the analysis of the mobile phones revealed compromising conversations for the investigated, in which there were derogatory and degrading comments about the complainant.

The Prison Sentences They Face

The four players involved could face sentences ranging from one to five years in prison according to the Penal Code.

The sentence contemplated for the non-consensual recording would amount to a prison sentence of two and a half to four years. And a fine of 18 to 24 months. Meanwhile, for the one who recorded and disseminated, the sentence could be three and a half to five years.

These sentences would be lower for those who, without having recorded the video, disseminated it. In this case, the punishment is lower, between a prison sentence of one to three years and a fine of 12 to 24 months.

These sentences would also apply the aggravating circumstance of the victim's minority. The sentence would increase from two to three years and a fine of 18 to 24 months.
