As if nothing had happened. The truth was on FC Barcelona's side. The Sporting High Council has disavowed the conspiracy of Madridists Tebas and Louzán from LaLiga and the Federation.
Flick Can Use Olmo and Pau Víctor Whenever He Wants
Dani Olmo and Pau Víctor are already registered again.Flick hasn't included them in the line-up that Barça is presenting tonight against Athletic de Bilbao. However, both are available and with their paperwork up to date as of today.
The CSD has granted FC Barcelona the precautionary measure to provisionally register Olmo and Pau Víctor. The decision isn't final but responds to the 50 pages filled with legal arguments that Barça presented to assert its rights. This time, at the CSD, they were listened.
LaLiga and the Federation Will Keep Trying
Olmo and Pau Víctor will continue playing while the Federation and LaLiga will insist on the matter, trying to convince the CSD that Barça's arguments aren't valid.
The CSD has construed that Barça has complied with the financial fair play requirements. For the Council, it is absurd that, under these circumstances, they can't register two players they own and have under contract. It would be different if they wanted to incorporate a player without meeting the financial fair play requirements.
The CSD has believed more in Barça's legal arguments than in a Federation rule. The latter will soon be abolished and prevents a player from being registered twice in the same club in the same season.
Barça Questioned LaLiga and the Federation's Proceedings
Barça questioned in its allegation the fact that "the Monitoring Committee has the authority to grant or not grant the preliminary visa, nor the definite license of professional soccer players, noting signs of nullity by operation of law in the Agreement of the Monitoring Committee of the RFEF-LaLiga Coordination Convention."
The CSD has granted the precautionary measure to "observe the possible occurrence of a cause for nullity by operation of law and the existence of immediate and irreparable damage."
"Athletes Have the Right to Practice Their Profession"
The CSD understands that "pursuant to section 27 of the Sports Code, professional athletes have the right 'to a sports career according to their potential' with all guarantees and certainty." It adds that "FC Barcelona and its players are immersed in the Spanish Super Cup, the first official title of the season, with global visibility and impact, and in which only the teams that performed best in national competitions in the previous season participate."
The CSD considers that "not adopting this precautionary measure would cause serious economic and sports damage to the club. Above all, to the players. This could also harm the interests of the Spanish national team, as well as the rest of the national competitions, including LaLiga." Barça is relieved and the controversy intensifies.
The Full Ruling of the CSD
"The Sporting High Council (CSD) has granted this Wednesday the urgent precautionary measure requested by FC Barcelona and by players Dani Olmo and Pau Víctor. This measure, which shall be provisional until the appeal filed by the club and the aforementioned players is definitively solved, suspends the Agreement of the Monitoring Committee of the RFEF-LaLiga Coordination Convention, dated January 4, 2025, as well as the revocation of the sports licenses of the referred players. It also maintains the validity of such licenses until the present appeal is definitively solved. For the estimation of this urgent precautionary measure, the CSD has analyzed the appeal, consisting of 52 pages and more than 60 documents attached. In their argument, FC Barcelona, Dani Olmo, and Pau Víctor point out that the Monitoring Committee is exclusively attributed the functions of construing the application of the clauses of the RFEF-LaLiga Coordination Convention, monitoring compliance with what was agreed and promoting as many other activities that lead to the greater effectiveness of the Convention.
They question, therefore, the fact that the Monitoring Committee has the authority to grant or not grant the preliminary visa, nor the definite license of professional soccer players, noting signs of nullity by operation of law in the Agreement of the Monitoring Committee of the RFEF-LaLiga Coordination Convention. Notwithstanding the allegations that may be requested to judge the substance of the matter, the CSD has observed the possible occurrence of a cause for nullity by operation of law and the existence of immediate and irreparable damage, which would affect the rights prescribed in the current Sports Code of the players Dani Olmo and Pau Víctor, as well as their legal integrity.
In that sense, the CSD has assessed that, according to section 27 of the Sports Code, professional athletes have the right 'to a sports career according to their potentials' with all guarantees and certainty. At this time, FC Barcelona and its players are immersed in the Spanish Super Cup, the first official title of the season, with global visibility and impact, and in which only the teams that performed best in national competitions in the previous season participate. The CSD considers that not adopting this precautionary measure would cause serious economic and sporting damage to the club and, above all, to the players. This could also affect the interests of the Spanish national team, as well as the rest of the national competitions, including LaLiga. Finally, the CSD emphasizes that this judgment does not reach the substantive matters raised in the appeal."
